These Terms of Service ("Terms") are an agreement between you and Fox Works Inc. ("we", "us" or "our"), the company that operates GogoScreen (the "Service") at https://gogoscreen.com and in our web app. They apply to the website, the app, our API and our MCP server.
By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy, Refund Policy and Cookie Policy explain related parts of how the Service works and should be read with these Terms.
1. Who we are
GogoScreen is operated by Fox Works Inc., Toronto, Ontario, Canada. You can reach us at support@gogoscreen.com for support, or at info@foxworks.ca for other matters.
2. Your account
You need an account to use the Service. Our public pages, including these policies, pricing and documentation, can be read without one.
To create an account you must be at least 18 years old, or the age of majority where you live if that is higher. If you use the Service for a business or other organization, you confirm that you are allowed to accept these Terms for it.
Give us accurate information and keep it up to date. Keep your sign in details and API keys secret. You are responsible for what happens under your account. Tell us at support@gogoscreen.com straight away if you think someone else has used it.
Free video time is meant for one account per person. We may refuse free time to an account that appears to repeat an earlier sign up.
3. What the Service does
You give the Service the address of a website or web app and instructions about what to show. The Service visits that site, moves through it, takes screenshots and recordings, and uses artificial intelligence (AI) services to plan the walkthrough, write narration and review the result. It then produces a video with voiceover and captions. The voiceover is a synthetic voice made by text to speech services from the voice you choose. It is not a recording of a person reading your script.
Automated results can be wrong or incomplete. A video can show the wrong screen, miss a step, or describe something inaccurately, and some videos fail to finish. Review every video before you publish or rely on it.
When you start a video we hold enough of your video time to cover it. If the video finishes, we charge the length of the finished video and return the rest. If it fails or is stopped, we return the time we held.
We may change, add or remove features. If a change materially reduces what a paid plan includes, we will tell you before it takes effect.
4. Sites you point the Service at
Only use the Service on websites and apps that you own or that you are allowed to access and record in this way. If you give us sign in details for a site, they must be for an account you are allowed to use for this purpose. We recommend a demo or test account that holds no real customer data.
The Service only signs in on the sign in pages you approve, and uses your sign in details only to make the videos you ask for. We delete them once that work no longer needs them. Our Privacy Policy explains how we handle them.
You are responsible for what appears on the screens we record, including any personal information of other people, and for having the right to show it in a video.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent, deceptive or harmful;
- record or publish content you do not have the right to use, or that infringes someone else's rights or privacy;
- point the Service at sites or accounts you are not allowed to access, or use it to probe, scan or attack any system;
- try to get around limits, payments or security measures, including by opening extra accounts to collect free video time;
- interfere with or overload the Service, or access it by automated means other than our documented API and MCP server;
- copy, resell or sublicense the Service, or reverse engineer it, except where the law allows this despite these Terms; or
- use the Service to create content that is illegal or harassing, or that misleads people about who made it or what a product does.
If we reasonably believe you have broken these rules, we may stop a video, remove content, or suspend or close your account (see section 9).
6. Video time, plans and payment
Free time. Each new account gets 60 seconds of free video time. Videos made with free time carry a GogoScreen watermark. No payment details are needed for free time, and it has no cash value.
Plans. Our monthly plans and their prices are shown on our pricing page. Prices are in US dollars. Each plan includes a set amount of video time for each monthly billing period. Plan time you do not use by the end of a period does not carry over and is not refunded. If a renewal payment fails, the new period's plan time is added only once that payment succeeds.
Top ups. You can buy extra video time in whole US dollar amounts, from US$10 to US$4,999 per purchase before tax. Top up time does not expire and has no cash value.
Order of use. When you have more than one kind of time, we use plan time first, then top up time, then free time.
Taxes. Prices do not include tax. Any tax that applies is shown at checkout and on your invoice.
Payment. Payments are processed by Stripe. By subscribing you authorize us to charge your payment method at the start of each billing period until you cancel. Invoices for your payments are available on the Billing page of your account.
Automatic renewal and cancellation. Plans renew automatically every month until you cancel. You can cancel at any time with Manage billing, on the Video time or Billing page of your account. Cancellation takes effect at the end of the current billing period, and you keep your plan time until then. If you cannot open Manage billing, contact us and we will cancel for you.
Changing plans. If you move to a higher plan during a billing period, we charge the difference in price for the rest of that period right away. We then add a matching share of the extra video time the higher plan includes, which ends with that period like other plan time. If you move to a lower plan, the change takes effect at the start of your next billing period.
Price changes. We may change our prices. We will tell active subscribers at least 30 days before a new price applies to them, and it will apply from the start of a later billing period. You can cancel before then.
Refunds. Payments are not refundable except as set out in our Refund Policy or where the law requires a refund.
7. API and MCP access
Paid accounts can use the Service through our API and MCP server. Access works while you have an active plan or top up time left. API keys are not cancelled when a plan ends, and they work again once you have a plan or top up time. Our documentation describes the API. Keep your keys secret; anything done with your keys counts as done by you.
8. Your content and your videos
You keep ownership of what you give us, such as addresses, instructions, uploaded logos and files, and of the videos the Service makes for you. You may use the videos you create for your own lawful purposes, including publishing them.
You give us permission to host, copy, process, transmit and display your content and videos only as needed to run the Service for you, to keep it secure, and to meet our legal obligations. This includes sharing them with the service providers listed in our Privacy Policy.
You confirm that you have the rights needed to give us this permission and that your content does not break the law or anyone else's rights.
9. Suspension, closure and deleting your account
We may suspend or close your account, or refuse a payment, if we reasonably believe you have broken these Terms, if you dispute a payment with your bank, or if the law requires it. If our payment checks find fraud, such as card testing, we freeze the account as our Refund Policy describes. That policy also explains what happens to payments and video time in these cases. Where we can, we will tell you why.
While your account is suspended or frozen, you can still sign in to see your account and billing information and to cancel your plan. If you cannot, email us and we will cancel it for you.
You can delete your account at any time from the Account menu of the app, under Delete account. Deletion happens after a 30 day waiting period, during which you can change your mind from the same page. When you ask us to delete your account:
- your plan stops renewing straight away;
- if a renewal payment was already under way when you asked and it is collected anyway, we refund it, cancel the plan and add no time for it;
- the rest of the current billing period is not refunded; and
- any video time left on the account is deleted with it.
Our Privacy Policy explains what we delete and what we keep.
10. Other services
The Service relies on other companies, including payment, hosting, email, sign in and AI providers. Some features link to or depend on services we do not control. We are not responsible for those services, and your use of them can be subject to their own terms.
11. Our rights
The Service, including our software, designs, text and trademarks, belongs to Fox Works Inc. or to the people who license it to us. These Terms do not give you any right to them other than the right to use the Service as described here.
12. Warranties
We provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available", and we do not promise that it will be uninterrupted or error free, or that its videos will meet your particular needs.
Nothing in these Terms removes or limits any right or remedy that you have under consumer protection law and that cannot be removed or limited by an agreement.
13. Limits on our liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of the Service; and
- our total liability for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, and US$100.
These limits do not apply to liability that cannot be limited by law.
14. Your responsibility to us
If you use the Service for a business, you will cover our reasonable losses and costs, including reasonable legal fees, arising from a claim by someone else about your content, the sites you point the Service at, or your breach of these Terms, to the extent the law allows.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to the next sentence, the courts of the Province of Ontario will decide any dispute about these Terms or the Service. If you are a consumer, nothing in this section takes away a right you have under the law where you live to bring a claim in your local courts or to rely on that law's protections.
Before starting a claim, please contact us at support@gogoscreen.com so we can try to resolve the problem.
16. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the Service at least 14 days before it takes effect. The date at the top of this page shows when these Terms last changed. If you do not agree with a change, you can stop using the Service and cancel your plan before the change takes effect.
17. General
If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your account or these Terms without our written consent. These Terms, with the policies they link to, are the whole agreement between you and us about the Service.
